We will communicate material changes to scope or pricing whenever reasonably possible before proceeding with additional work.

5. Scheduling and Site Access

Scheduling is subject to weather, equipment availability, material availability, and other factors. We will make reasonable efforts to complete work within the estimated time frame but cannot guarantee specific dates.

The customer is responsible for providing safe and reasonable access to the property, including gates, driveways, and access routes for trucks and equipment. If access is restricted or unsafe, we may reschedule or adjust the scope of work.

6. Site Conditions and Utilities

The customer is responsible for informing Cournaya’s Land Enhancement about known underground utilities, septic systems, drain fields, irrigation lines, private lines, and any other buried structures that could be affected by the work.

We perform work based on the information provided by the customer and any visible indicators on the property. We are not responsible for damage to unknown or unmarked underground utilities or structures that are not properly identified prior to work starting.

7. Materials and Natural Conditions

Materials such as stone, gravel, topsoil, mulch, sand, crushed concrete, and asphalt millings are natural or processed products that can vary in color, texture, and composition. We do not guarantee an exact color match or appearance beyond what is typical for that material type.

Land and driveway work is affected by weather, drainage patterns, soil type, and other natural conditions beyond our control. We will make reasonable efforts to grade and shape areas to perform well, but we cannot guarantee performance against extreme weather or conditions that change after the project is completed.

8. Payments

Payment terms will be described in your estimate or invoice. Unless otherwise stated in writing:

  • A deposit may be required to secure scheduling or purchase materials
  • The remaining balance is typically due upon substantial completion of the work
  • Invoices not paid within the agreed timeline may be subject to late fees or collection efforts

Ownership of delivered materials may remain with Cournaya’s Land Enhancement until payment is received in full.

9. Changes, Delays, and Cancellations

If you need to change or cancel scheduled work, please contact us as soon as possible at the phone number or email address provided. Certain changes or cancellations may result in additional charges if materials have already been ordered or delivered, or if equipment has been mobilized.

We reserve the right to reschedule or suspend work due to unsafe conditions, severe weather, equipment failure, or other circumstances beyond our control.

10. Workmanship, Guarantee, and Warranty

We take pride in our workmanship and aim to perform all work in a professional and careful manner. If you have concerns about recently completed work, please contact us promptly so we can review the site with you.

Any guarantee or workmanship warranty described on our website or in our written materials is limited to the original scope of work and is subject to natural conditions, site changes, weather events, and property use after the work is completed. Normal wear, erosion, and damage from vehicles, equipment, or other third parties are not covered.
